Lori Rittel is stuck in her Florida Keys home, living in the wreckage left by Hurricane Irma two years ago, unable to rebuild or repair. Now her best hope for escape is to sell the little white bungalow to the government to knock down.

Her bedroom is still a no-go zone so she sleeps in the living room with her cat and three dogs. She just installed a sink in the bathroom, which is missing a wall, so she can wash her dishes inside the house now. Weather reports make her nervous. “I just want to sell this piece of junk and get the hell out,” she said. “I don’t want to start over. But this will happen again.”

The Great Climate Retreat is beginning with tiny steps, like taxpayer buyouts for homeowners in flood-prone areas from Staten Island, New York, to Houston and New Orleans — and now Rittel’s Marathon Key. Florida, the state with the most people and real estate at risk, is just starting to buy homes, wrecked or not, and bulldoze them to clear a path for swelling seas before whole neighborhoods get wiped off the map.

By the end of the century, 13 million Americans will need to move just because of rising sea levels, at a cost of $1 million each, according to Florida State University demographer Mathew Haeur, who studies climate migration. Even in a “managed retreat,” coordinated and funded at the federal level, the economic disruption could resemble the housing crash of 2008.

The U.S. government’s philosophy has been that local officials are in the best position to decide what needs to be done. Consequently, the effort has so far been ad hoc, with local and state governments using federal grants from the last disaster to pay for buyouts designed to reduce the damage from the next one.

“The scale of this is almost unfathomable,” said Billy Fleming, a landscape architecture professor at the University of Pennsylvania. “If we take any of the climate science seriously, we’re down to the last 10 to 12 years to mobilize the full force of the government and move on managed retreat. If we don’t, it won’t matter, because much of America will be underwater or on fire.”

If not for the $174,000 that Rittel, 60, owes on her mortgage, the Montana transplant would have left long ago. Insurance money is insufficient to rebuild, so she applied for one of the buyouts, administered by the state with $75 million of Irma-relief cash from the U.S. Department of Housing and Urban Development, as long as it lasts.

Florida accounts for 40% of the riskiest coastal land in the U.S., according to the Union of Concerned Scientists, but it’s done little so far to pull people back from the coasts and lags behind states such as New Jersey, North Carolina and Texas. Across the country, the effort is still more theory than practice, even as a consensus among planners grows that “managed retreat” may be the best of bad options.

This year, HUD made available $16 billion for climate resilience, its first dedicated fund to fortify for future storms. Nine states, plus Puerto Rico and the Virgin Islands, will decide how to use it, whether to build sea walls, put houses on stilts or move people out of the way. The money is a fraction of what’s needed, and the process is moving at the speed of government.

A study by the Natural Resources Defense Council this month found that buyouts by the Federal Emergency Management Agency, which responds to disasters, take five years on average to be completed. By that time, many homeowners have rebuilt or moved. Similar data isn’t available on the grants from HUD, which also provides money to demolish homes.

“It’s a slow-motion emergency,” said Rob Moore, director of NRDC’s water and climate team. “But it’s happening right now. These last three hurricane seasons show us what it kind of looks like.”

A FEMA spokesman said the agency supports the  voluntary acquisition of flood-prone structures and provides the grant funding, but the prioritization of projects happens at the local level first and then by the state acting as the recipient. The agency believes each county floodplain manager and local official knows the needs of their communities best and are responsible for land usage and permitting.

About 6 million Floridians will need to move inland by century’s end to avoid inundation, according to Hauer, the demographer, in a 2016 paper. By then, about 80% of the nearby Keys, the archipelago that includes the tourist mecca of Key West, will be underwater. About 3.5 million people would be flooded in South Florida’s Miami-Dade and Broward, the two counties with America’s biggest exposed populations.

“Florida’s doing it at a really small scale,” said A.R. Siders, an assistant professor at the University of Delaware who studies climate adaptation. “Compared with the new housing units going up in South Florida, I don’t know if that would even cancel out.”

But Florida runs on tourism and real estate revenue, and managed retreat is a phrase that makes real estate listing agents nervous. But there’s another Florida housing bubble waiting to pop. The Union of Concerned Scientists warns of a coming housing crash — from Miami to San Mateo, California — on a scale worse than last decade’s foreclosure crisis, caused by climate change — from flooding to heat waves and wildfires.

Cities are only starting to grapple with where to resettle residents, and how to transport communities and hometown identities. And homes on higher ground will also demand higher prices, worsening an affordability crisis.

Fifteen years after Hurricane Katrina, Louisiana is trying to relocate the Native American settlement of about 100 people on the Isle de Jean Charles, a narrow island that lost 98% of its land over the past six decades to climate change. It’s working with a $48 million grant from HUD for buyouts and to help them start anew on a 500-acre sugar cane field 40 miles north that the government will populate with homes and businesses. Importantly, it will be 9 feet above sea level. All but three of about 40 households have signed on.

“They’re starting to scale this up,’’ said Jesse Keenan, a social scientist at Harvard University who also specializes in climate adaptation. “This is about building up institutional knowledge on how to do this.’’

​​​​​​​New Jersey has a $300 million fund for buyouts and has purchased hundreds of houses since Superstorm Sandy in 2012, though like Florida, even more homes have been built on the coast in the meantime. Harris County, Texas — which includes Houston, ravaged by a series of storms including 2017’s Harvey — has done more than 3,000 FEMA buyouts, more than any other county in the U.S., according to NRDC.

In Monroe County, Florida, where Rittel lives, the planning is just beginning. The county has applied for $5 million of the HUD money — the state maximum. Already, about 60 local homeowners have applied, so it will require triage. Senior citizens, families and residents in the riskiest flood zone would get priority, said Assistant County Administrator Christine Hurley.

Rittel isn’t sure how long she can hang on.

Her insurance payout of about $100,000 would cover repairs to the 640-square-foot house. But the county requires that when more than 50% of a home is damaged, that it be completely rebuilt to meet modern storm-resiliency codes and — in her flood zone — on stilts. That would cost at least $200,000, money she doesn’t have.

She dreams of resettling in Key West or Homestead, a safer spot on the Florida mainland.

“I’d like to take the money and run,” Rittel said. “But I’ll have to buy something on stilts. I’m not buying anything on the ground down here ever ever again.”

SOLAR FARM

The site of the solar farm development enjoys the best solar profile in the United States and is near major urban centers including San Diego, Los Angeles, and Phoenix. The electricity generated could be sold to the local electric power utility company at prevailing Power Purchase Agreement rates of about .07 per kilowatt hour (KwH). However, through the use of proven electric storage technology, the value of the electricity could be significantly increased through the selling into the power grid during peak demand periods at much higher spot market prices. Selling power in this manner is called Regulation Services.

ELECTRICITY STORAGE

Deployment of electricity storage is increasing at explosive rates and has been described by the Edison Electric Institute (EEI) as a game changer in the industry. Several new companies can provide large battery-based storage units and have the operating systems required to interact with the electricity grid. Through storing electricity and injecting the stored power into the grid during peak demand periods the cost of peaking power can be greatly reduced. By selling power into the grid during peak demand at much higher prices the value of the solar power farm can be greatly enhanced.

When electricity storage is not available, excess solar electricity is wasted. Resiliency takes center stage in new projects around the country

Projects like these, where resilience is central to their design and construction, are becoming more commonplace.

On July 28, the New Jersey Department of Environmental Protection awarded AECOM and a team that includes OMA, Magnusson Klemencic Associates, and Matrix New World Engineering the final design contract for a resilience project along the Hudson River. The primary goal is to reduce flooding in Hoboken, which has 2.3 miles of coastal exposure, and parts of Weehawken and Jersey City.

The approach of this project, which HUD awarded $230 million through its Rebuild by Design contest, has four integrated resilience components:

  • Resist, through a combination of hard infrastructure like bulkheads and floodwalls, and soft landscaping like berms that might double as parks.
  • Delay, through policy changes and infrastructure that slow stormwater runoff.
  • Store, with green and gray infrastructure improvements, such as bioretention basins and swales, to capture stormwater.
  • Discharge, by enhancing stormwater management systems and upgrading infrastructure such as sewer lines.

Skidmore, Owings & Merrill, which is working on a separate project to redevelop Hoboken’s Terminal and Rail Yard into a mixed-use transit-oriented community with more than $100 million in improvements, is coordinating its efforts with the Rebuild by Design team, whose study area encompasses the terminal/rail yard.

Projects like these, where resilience is central to their design and construction, are becoming more commonplace, as developers and their AEC teams adopt positive measures to give their property assets a fighting chance of surviving the ravages of natural disasters, and to minimize recovery costs.

The replacement Ocosta Elementary School in Westport, Wash., which opened in the fall of 2016, offers a safe haven of refuge to students and residents who would have less than 30 minutes to evacuate in the event of a tsunami. The 23-classroom school includes the first vertical shelter in North America, a rooftop evacuation platform 53 feet above sea level that’s accessible via four flanking stair towers enclosed in concrete.

The platform, which is anchored by concrete piles that extend 55 feet into the ground, can hold more than 1,000 people and withstand a 9.2-magnitude earthquake and the impact of incoming waves. Resilience accounted for $2 million of the school’s $16 million project cost.

Three-thousand miles to the east, a seven-acre site with 1,700 lineal feet of shoreline along East Boston’s waterfront is being transformed into Clippership Wharf, a mixed-used development that will have 478 apartment units on two finger piers. Owner/developer Lendlease took over this project from a previous developer that had planned for lots of surface and underground parking. “That’s just not right for this day and age,” says Nick Iselin, Leadlease’s General Manager of Development. Lendlease rewrote the plan with several resilience measures, including replacing old seawalls that had been part of the site’s industrial infrastructure.

Lendlease is converting one of the piers into a “living shoreline” by creating a series of terraces for new salt marshes and a habitat for Boston Harbor, which is subject to a 10-foot tidal influence. The first floor of each building will be 24 feet above Boston City Base. All infrastructure and mechanical systems will be located above the 100-year flood level. Garage levels will be flood resistant.

To meet Boston’s “Living with Water” ordinance, Lendlease created a 1,400-foot Harbor Walk that will be 14-16 feet above the water level. In all, Clippership Wharf will have 189,830 sf of open space.

Back on the West Coast, there’s a 28-acre parking lot south of AT&T Park, where the San Francisco Giants play, that is subject to sea levels that vary as much as 24 inches. Predictions estimate those levels could rise to 66 inches by 2100.

“We needed to manage that risk,” says Kristen Hall, LEED AP, Senior Urban Designer with Perkins+Will, which has written the design controls for the proposed mixed-used redevelopment of this waterfront site, called Mission Rock. Eventually, it will encompass 11 city blocks and include eight acres of parkland, 1,500 rental units, and a million sf of office space. The Giants and the Port of San Francisco are co-developers.

The design, Hall explains, calls for the creation of a mesa down the middle of the site, with minimal frontages that may flood. She calls these frontages the site’s “sacrificial edges.” Other edges will include loading docks that create redundant elevated building access, as the majority of Mission Rock’s buildings would be at higher elevations. The park area would use a series of grade changes as design features, such as an amphitheater, a sloped lawn, steps, and ramps.

In July, the first phase of the Cornell Tech applied science campus was completed on Roosevelt Island in New York City’s East River. That phase includes The House, a residential complex with 350 apartments for staff and faculty, and Bloomberg Center, a four-story, academic building.

The buildout of this 12.4-acre, $2 billion campus is expected to proceed through 2043 and expand to two million sf. SOM, in collaboration with Cornell University and Technion – Israel Institute of Technology, is the project’s master planner. Resilience is key to protecting this property.

Colin Koop, AIA, SOM’s Design Director, explains that the East River is a tidal estuary, and significant portions of the site lie within 100- and 500-year floodplains. So all of the architecture needs to be elevated. The main pedestrian walkway, called Techwalk, will allow people to enter the campus at its periphery and then rise gently through its open spaces at a slope that is largely imperceptible. Once they reach the central ridge, they would be surrounded by permeable façades “that help create a synergy between inside and outside spaces on campus,” he says.

Cornell, says Koop, has been a “sophisticated client that is grappling with realities larger than itself and this project.”

If the benefits of a sustainable retrofit are so robust, why isn’t everyone doing one?

A sustainable retrofit includes replacements and upgrades that result in lower energy, operating and maintenance costs as well as improved occupant satisfaction. A sustainable facility will have a small carbon footprint, limited environmental impact and conserves natural resources. They can range from replacing conventional lights to LED bulbs, adding motion-control switches and installing low-flow water fixtures to installing a green roof, replacing the building skin and adding solar panels to all of the above.

When you fully understand the economic benefits of doing a sustainable retrofit which include lower expenses and rent and occupancy premiums resulting in higher NOI as well as reduced cap rates resulting in higher long-term values, you realize how few property owners, managers and tenants have actually made the decision to pursue an upgrade of their building(s), it initially does not compute a United Nations Environmental Program Finance Initiative Investor Briefing entitled “Unlocking the energy efficiency retrofit investment opportunity” reports:

  • Buildings with the Energy Star label had significantly stronger performance than similar unlabeled buildings: 13.5% higher market values, 10% lower utility costs, 5.9% higher Net Operating Income (NOI) per square foot, 4.8% higher rents and 1% higher occupancy rates.
  • A study using Co-star data concluded that LEED-certified buildings and Energy Star rated buildings versus non-rated buildings had 8% higher effective rents (a function of both the rental amount and the occupancy rate) and a 13% sales price premium.

In a 2012 study by The Rockefeller Group and Deutsche Bank Climate Change Advisors, however, reported that approximately $72 billion in capital is needed to be invested in sustainable retrofits to effect profitable energy efficiency in the existing building stock. However, the total spent in 2012 was just $1.5 billion.

Once you understand the relative perspective of the stakeholders in both the investment and the benefits, the resistance to effecting a sustainable retrofit can be understood.   Let’s dissect the framework in which the decision to make sustainable improvements are made and the issues and motivations that cause a property owner not to update and improve their property which are:

  • Short-term investment horizon
  • Incongruous lease structure
  • Capital and operating budget limitations
  • Financing availability, complexity and/or cost
  • Limited knowledge, time and/or motivation to effect energy upgrades

Understanding these investment, operational and financial constraints is the first step in developing solutions that will result in making the sustainability and resiliency of the existing stock of commercial buildings feasible and practical.

Short term investment horizon:

In the era of REITs, CMBS, hedge funds, crowdfunding and private equity, investment hold periods are frequently in the 3 – 7 year range when investors can typically optimize the IRR and other profitability measures or bail on a bad investment and reallocate their capital. As a result, many investors will only consider sustainability measures that have a two-to-three year payback period. Deep energy retrofits with savings of 30% to 50% that result from retrofitting multiple building systems requiring more time and capital to effect are tabled and not done.

Solution: The current and prospective investment environment will continue to reflect hold periods that are relatively short; however, the solution is for investors, owners and managers to realize that a sustainable retrofit enhances the long-term value of the property and will cause investment returns to increase. Including the costs and benefits of upgrading a building is a common way for sponsors to demonstrate the inherent value of a property – especially one that is not fully leased or suffers from functional obsolescence or poor aesthetics and other physical limitations on its marketability to prospective tenants. Many business plans include upgrading a building from one class to a higher class which results in increased rents and lower cap rates. As evidenced by many studies, including sustainability and resilience in the business plan is an increasingly important component in any market-oriented building upgrade. The solution is for sponsors, investors and owners to realize this and to put it into practice.

Future articles will present sustainable ideas many of which can be implemented with no capital investment required.

Incongruous Lease structure

Commercial buildings, a/k/a income properties, are leased to tenants pursuant to a variety of lease structures with the four most common being as follows:

  1. Gross Lease, or full service gross, is a lease where the landlord/owner collects a stipulated rent amount and is pays all expenses including real estate taxes, insurance and operating expenses that are comprised of utilities, repairs and maintenance and management. The room rate paid for a night in a hotel and a lease for a self-storage unit are examples of gross leases.
    • Apartment leases are typically considered to be a gross lease as the landlord is usually responsible for all operating expenses including real estate taxes, building insurance, common area maintenance and utilities, and property management while the tenant is responsible for the unit’s electricity (and sometimes water) and interior maintenance.
  2. Modified Gross Lease is a gross lease where the landlord/owner collects a stipulated rent amount plus a reimbursement of real estate taxes, insurance and operating expenses which exceed an agreed upon amount which is typically an estimate of the building expenses for the initial lease or calendar year. Typically, at the end of the year, the actual expenses are reconciled to the estimate and any increase is passed to the tenant based on its pro-rata share. Most multi-tenanted office buildings are leased pursuant to modified gross leases.
  3. Net Lease is a lease where the landlord/owner collects a stipulated rent amount plus building expenses which include real estate taxes (net), taxes and insurance (double net); or taxes, insurance and operating expense (triple net) depending on the terms of the lease. If the building is multi-tenanted, the tenant pays its pro rata share.   Most net leases are currently triple net. Retail properties are typically leased using a triple net lease.

In a standard Full Service lease, there is no split incentive in the lease structure as any and all savings realized from a sustainable retrofit inure to the benefit of the owner; however, the property manager may not be incentivized to promote a retrofit as it would be responsible for supervising and effecting the improvements without any additional management fees. With regard to an apartment complex, the landlord’s incentive to invest in energy efficiency measures is limited to the common areas – or to improve the competitive position and marketability of the units to prospective tenants.

In a standard Modified Gross lease as well as a Net lease, the landlord/building owner is not incentivized to invest the time, money and personnel resources to effect a sustainable retrofit as the landlord receives no direct financial benefit as the tenant pays the operating expenses and receives all of the benefit of lower operating costs.

Solution: Creating a lease structure that equitably aligns the costs and benefits of efficiency, sustainability and/or resiliency between building owners and managers, known as a green lease, aligned lease, high performance lease or energy efficient lease, will create sustainable and substantial benefits, both quantitative and qualitative, for both tenants and owners/landlords.

  • According to Jones Lang LaSalle, “A green lease need not be complicated. Often it merely requires structuring terms and agreements already in place, such as temperature settings and building operating hours, in a fashion that provides sustainable cost savings with negatively impacting building performance.”

To effect a green leasing program that includes both current and prospective tenants, engaging a consultant that understands both commercial lease structures and efficiency and sustainability retrofits to maximize the sustainable benefits to be derived therefrom.

Green leases will be addressed in detail in a future article.

Capital and operating budget limitations

Many properties suffer from a breakdown in communication and financial planning between building managers and building owners.   Building managers typically operate a facility pursuant to a one-year budget which causes them to budget and implement projects with a short term (1- 2 years) payback period. Consequently, capital improvements that have a longer payback period are not often recommended by management, or if recommended, not implemented by ownership due to a combination of knowledge, time or motivation to consider an energy upgrade or a perceived lack of available capital. This short-term horizon again limits the nature and extent of any efficiency or sustainable upgrades and prevents ownership from reaping all of the economic benefits that inure from a building retrofit.

Further, many times neither building ownership nor building management understand the nature and availability of financing options, tax credits, utility and local government rebate programs. Some of the programs, or a combination of programs, can result in building owners not having to come out of pocket to fund the improvements; however, the unique nature of them requires time which is typically focused on achieving the primary business goals of the organization.

Solution: Engage a sustainability consultant with knowledge of property operations and management as well as the nature of the available financing, credits and rebates – and how to source and evaluate alternatives in order to minimize actual investment dollars and the cost of any financing incurred.  Conducting a life-cycle analysis in addition to other financial analyses will provide ownership with the information needed to make the business decision.

Financing availability, complexity and/or cost

Contrary to popular belief, energy efficiency and sustainability retrofits benefit from a variety of financing alternatives. However, for real property professionals who work with mortgage loans, mezzanine loans, preferred equity and similar forms of financing, retrofit financing options ranging from equipment leases to ESCO (Energy Service Company) contracts and PACE (Property Assessed Clean Energy) liens is a whole new world. When you add in the variety of tax credits, utility rebates and vendor financing, the options become complex.

Further, the sources for financing a retrofit are not usually the same ones that provide mortgage financing so it is a new arena which makes accessing sources and evaluating options time consuming and prohibitive.

Solution: Engaging a professional who is familiar with the types and sources of retrofit financing as well as the typical structures and issues of which owners should be aware is the easiest and most efficient way to determine and evaluate the options based on the financial and non-financial objectives of the owner.

The various retrofit financing options, examples of tax credits and utility and municipal rebates will be described and explained in future posts.

Limited knowledge, time and/or motivation to effect energy upgrades

In today’s competitive commercial real estate environment that is still recovering from the devastatingly harsh Great Recession of 2007, keeping your focus on the primary business of keeping space leased (as hoteliers say – heads in the beds) and watching every penny to the bottom-line is the first priority of owners and managers.

Even though the results of an efficiency, sustainability and/or resiliency retrofit provide a substantial boost to the net operating income (and cash flow) of a property, it does not become a high priority item due to lack of understanding of the process, the capital, management and labor requirements, the extent of the potential disruption to operations and tenants as well as knowledge of the additional value (rent premiums, occupancy premiums, higher quality tenancy, lower cap rate, increased investment value) and business benefits (reputation, image, goodwill) to be derived therefrom.

Also, many times building management staff, who may have the understanding of the sustainability technology will not have the financial literacy to present a compelling case to ownership.

Further, many energy service providers (who are typically considered to be the expert in facilitating a retrofit) do not know or understand the financing options that are available to building owners. Accordingly, these professionals are not able to property advise an owner on energy project financing.  Accordingly, many owners are not aware of, nor understand, the variety of financing mechanisms available to them.
